HRAWI Issues Public Advisory : Music License Not Required for Marriage Procession and Other Social Festivities Associated With A Marriage https://dailypioneer.in/hrawi-issues-public-advisory-music-license-not-required-for-marriage-procession-and-other-social-festivities-associated-with-a-marriage/ Fri, 22 Nov 2024 12:44:48 +0000 https://dailypioneer.in/?p=5914 Mumbai, Nov 22: The Hotel And Restaurant Association (Western India) – HRAWI has clarified the legal stance regarding obtaining music licence for a marriage and other social festivities associated with a marriage at hospitality establishments. The clarification comes in response to recent confusion caused by certain private agencies claiming that music licenses are now mandatory for such events. HRAWI has re-confirmed that there is no change in Indian law and a marriage procession and other festivities associated are exempt from music licensing requirements. There will be no infringement of playing music at such events. It stated that any private agency seeking payment for licenses for a marriage and related celebrations would be acting contrary to the provision of Section 52(1)(za) of the Copyright Act.

“We have received reports of private agencies misleading hotels and guests regarding the need for music licenses at marriages and related/associated festivities. Some agencies are also publishing misleading reports suggesting the exemption for a marriage is no longer valid. These agencies are citing the Hon’ble Goa High Court Order dated 13.08.2024 and the DPIIT Public Notice dated 07.11.2024, misinterpreting it as a legal requirement to obtain music licenses. HRAWI has verified that Section 52(1)(za) of the Copyright Act, 1957, which exempts marriage-related festivities from licensing requirements, remains intact and enforceable,” says Mr Pradeep Shetty, Spokesperson & Hon’ Secretary, HRAWI.

The DPIIT, in a Public Notice dated 24.07.2023, had informed the public that marriages and related social festivities were exempted from requiring music licenses as per Section 52(1)(za) of the Copyright Act, 1957. In a subsequent notice dated 07.11.2024, the DPIIT placed the previous notice under abeyance. However, HRAWI has clarified that the Public Notice in any event was an explanatory note and did not establish new legal requirements.

“Additionally, even the Hon’ble Goa High Court Order does not address the interpretation or implications of the law related to music licensing for a marriage and related social events. Consequently, any claims suggesting that the Order nullifies the exemption under Section 52(1)(za) are incorrect. The law remains clear, a marriage and associated social festivities are not subject to royalty payments or licensing requirements for music,” says Mr. Nirav Gandhi, Senior Vice President, HRAWI.

The Association has emphasized that the Government of India has neither revoked nor amended its earlier public notice regarding music licensing for marriages. Furthermore, the DPIIT public notice dated 07.11.2024 does not suggest any new requirement for licensing in connection with marriage-related events. Section 52(1)(za) of the Copyright Act, 1957 remains valid, preserving the existing exemption for the public and guests regarding the use of music during marriage ceremonies and associated social festivities.

With the wedding season underway, HRAWI has issued a circular to its members to ensure that the public is not misled by false claims from private agencies seeking fees unlawfully. The Association has urged vigilance to prevent harassment and to protect the public from unnecessary payments.

“It is evident that the recent DPIIT notice is being misinterpreted to suggest that hospitality establishments or the public must obtain licenses for music at marriages and related events, which is simply untrue. We have advised members to reassure their guests about the legal exemption for music licensing in these festivities and to facilitate their events license-free. Any demand for licensing fees by private agencies for such events is not lawful and breaches Section 52(1)(za). We urge members to contact us if such demands arise so we can address the matter in Court,” concludes Mr Shetty.

Elakshi opens up on her regime and how amid such hectic schedules she never fails to give time to her body she says, “Before starting this shoot for the serial, I used to do my workout almost 5 days a week and follow my routine diet with proper nutrition. But then, I faced challenges when I started shooting,” Elakshi reveals.

With approximately 18 days between the shooting, traveling from her home base in Pune, where she also has her dental clinic, and traveling back to Mumbai, she has limited days left for dedicated workouts.

“I get only 12 days for my workout, and sometimes even that isn’t possible. If I’m unable to do my workouts regularly, I ensure that I follow my nutrition and diet plan, especially my intermittent fasting cycle,” she explains.

She reveals how diet and intermittent fasting always energize her, “Whenever I’m on set, I make sure I have my breakfast by 9 a.m. and finish my last meal around 6:30 p.m.,” she shares. My intermittent fasting plan helps me keep weight in check even when workout time is limited. I prefer having paneer paratha or chilla for breakfast because it keeps me energized until my lunch break at 2 p.m. If I’m home, I might have oats with protein powder, dry fruits, and black coffee. I don’t take milk tea; black coffee is my go-to. I avoid chapatis and wheat, but instead, I choose 50 grams of rice and 100 grams of veggies, along with paneer or dal, for protein. I avoid eating packets, fried foods, and sweets but when I crave I have a small bite of it and work out a bit hard the next day”

Elakshi opened up while being on the TV set about how she incorporates physical activity, saying, “I prefer taking stairs over lifts, even at the airport or during shoot breaks. If I want something, I don’t call Spot Dada and ask him to get me this, instead, I go to him and tell him so even a little bit but my body moves which helps me to keep my body active and keep me away from laziness.” she says.

Elakshi’s routine proves that even with a packed schedule, maintaining fitness is achievable. Elakshi Gupta’s balanced routine is an inspiring example for anyone looking to stay fit while managing a busy life.

We were making our way to the Rila Mountains, where we were visiting the Rila Monastery where we enjoyed scrambled eggs, toast, mekitsi, local jam and peppermint tea.

We wandered the site with other tourists

Yet strangely the place did not seem crowded. I’m not sure if it was the sheer size of the place, or whether the masses congregated in one area and didn’t venture far from the main church, but I didn’t feel overwhelmed by tourists in the monastery.

Headed over Lions Bridge and made our way to the Sofia Synagogue, then sheltered in the Central Market Hall until the recurrent (but short-lived) mid-afternoon rain passed.

Feeling refreshed after an espresso, we walked a short distance to the small but welcoming Banya Bashi Mosque, then descended into the ancient Serdica complex.

We were exhausted after a long day of travel, so we headed back to the hotel and crashed.

I had low expectations about Sofia as a city, but after the walking tour I absolutely loved the place. This was an easy city to navigate, and it was a beautiful city – despite its ugly, staunch and stolid communist-built surrounds. Sofia has a very average facade as you enter the city, but once you lose yourself in the old town area, everything changes.

Clothes can transform your mood and confidence. Fashion moves so quickly that, unless you have a strong point of view, you can lose integrity. I like to be real. I don’t like things to be staged or fussy. I think I’d go mad if I didn’t have a place to escape to. You have to stay true to your heritage, that’s what your brand is about.
